What happens if I never file bankruptcy? If you never file for bankruptcy you creditors can sue your for the money owed. After receiving a judgment they can proceed to levy your bank accounts, garnish your wages and place a lien on your real property. Failure to pay the debt and ignore the debt just postpones your ability to get new credit and obtain the "fresh start" that bankruptcy provides. If you marry prior to paying off your debt your new wife's earnings can also be subject to garnishment after marriage. California is a community property state.
