Can someone on a visa file for bankruptcy?
I have a visa, but I am not sure if I can file for bankruptcy here in the US. Is it possible for me?LawQA.com Answer Library

In most cases you must have a social security number to file. If you do then you can file.

You do not need to be a citizen to file bankruptcy. You need only be present for 180 days prior to filing to qualify as eligible.

11 USC 109(a) Who may be a debtor "... a person that resides or has a domicile, a place of business, or property in the United States ... may be a debtor under this title ..." consult with a lawyer as to the effect of the case on foreign held debt however.

I don't believe that if you are here on a visa that you can file for bankruptcy. Only citizens and legal residents are able to take advantage of the US bankruptcy options.

Yes, you can file if you are here on a visa. The people who can't are ones who used a fake SSN number to open credit accounts.

Typically to file for bankruptcy you must have either a social security number or a tax ID number.

Yes, someone with a Visa can file bankruptcy. A person has to have lawful presence in the U.S. in order to file bankruptcy. A Visa satisfies that requirement.

Immigration has nothing to do with bankruptcy nor bankruptcy has anything to do with immigration. You do not have to be a citizen or even a permanent resident to file for bankruptcy. A person on a visa or a person undocumented can file for bankruptcy relief just like anyone else. If you do not have a social security number you can use the Individual Tax Identification Number (ITIN) provided by the IRS to file income taxes. You can identify yourself at the meeting of creditors with your passport and present the ITIN card if you do not have a social security number and had to file using the ITIN. Immigration forms do not ask whether or not you ever filed for bankruptcy and bankruptcy forms do not ask for your citizenship or immigration status.

What kind of visa? How long have you been here and how long are you staying? Bankruptcy doesn't affect green cards, for example, as long as there's no fraud involved.
