Question

Is there anything I can file if my bankruptcy file was discharged?

My Chapter 7 bankruptcy was discharged on 8/4/2011. Is there anything I can file? Without an attorneys help since I can't afford one? I am trying to buy time and I want to stay in my house. Eventually I wish to hire an attorney and sue my bank for my house due to fraud and any other illegal activity that a lawyer can find.

I'm sorry, but I don't understand your question. If you have a claim against your bank that existed before you filed your bankruptcy case, you were required to list it in your bankruptcy papers. If you did not do so, then any cause of action you have against the bank still belongs to the bankruptcy trustee and he/she must be notified.

Your chapter 7 has been discharged so the lender on your house can foreclose if you are behind. If you have a cause of action against the lender you can sue. You also may want to consider filing chapter 13.

If the bankruptcy discharged, once the case closes there is nothing you can do. You can look into working with the lender for a modification to see if you can stay in the house longer.

If the bankruptcy is done, it is done. After your discharge there is no more automatic stay.
